Compulsory legal expertise is one of the main activities of the Center.
In accordance with par. 1 of Article 47 of the Law of the Republic of Belarus from 17 July 2018 No. 130-Z On Normative Legal Acts (hereinafter – the Law) the Center shall carry out compulsory legal expertise of draft laws to be submitted to the House of Representatives of National Assembly of the Republic of Belarus, prepared for consideration by the House of Representatives of the National Assembly of the Republic of Belarus in the first and second reading (in the case of adding amendments to draft laws in the House of Representatives of the National Assembly of the Republic of Belarus).
The methodology for conducting compulsory legal expertise by the Center is determined in the Methodological Rules for the Preparation of Conclusions of Compulsory Legal Expertise of Draft Laws, approved by the Order of the Director of the Center from 10 August 2006 No. 33.
According to Article 50 of the Law the Center’s conclusion is one of the obligatory documents attached to the draft law submitted to the House of Representatives of the National Assembly of the Republic of Belarus.
There have been legally established the time frames for submission of draft laws included in the annual plan for the preparation of draft laws for the next year and for compulsory legal expertise carried out by the Center.
Thus, in accordance with par. 4 of Article 47 of the Law, the draft laws included in the annual plan for the preparation of draft laws shall be sent to the Center for compulsory legal expertise no later than thirty days before submission of draft laws to the House of Representatives of the National Assembly of the Republic of Belarus.
Compulsory legal expertise of the draft code shall be carried out within thirty days, of another draft law – within fourteen days (par. 5 of Article 47 of the Law).
