Methodical supervision of preparing draft legal acts

The methodical supervision of preparing draft legal acts is carried out by the National Center of Legislation and Legal Information in following forms:

• preparation of draft legal acts in the field of norm-making activity;
• organization of training courses for employees of state authorities and other organizations on current issues in the field of law, including conferences (symposiums, seminars), in accordance with approved plans, under the instruction of the President of the Republic of Belarus or the Administration of the President of the Republic of Belarus, or on the basis of concluded agreements;
• generalization of non-settled rules of the norm-making technique and of other problems arising in the norm-making activity for the purpose to determine uniform approaches for solving such problems including through holding of round-table discussions with the participation of interested state bodies (organizations) and with the subsequent forwarding of the round-table recommendations to the interested state bodies (organizations) for application in the norm-making activity;
• preparation of explanations on the issues of the application of legislation which regulates the norm-making activity, including activity related to the application of the requirements of norm-making technique;
• preparation of scientific and practical comments on codes and other laws;
• giving consultations to the employees of state bodies (organizations);
• conducting classes on issues of the norm-making activity (participation in their conducting) in state bodies (organizations), at the Institute of Civil Service of the Academy of Public Administration under the aegis of the President of the Republic of Belarus;
• methodical support of normative legal acts prepared by the National Center of Legislation and Legal Information;
• organizing training courses within the National Center of Legislation and Legal Information for employees of state bodies (organizations);
• ensuring the forming of thematic databanks «Law Enforcement Practice» and «Norm-Making» (templates for draft normative legal acts, methodical materials on norm-making, etc.) of the information retrieval system «Etalon»;
• maintaining and support of the Law Forum of Belarus by the National Center of Legislation and Legal Information.

The practical commentary prepared by the National Center of Legislation and Legal Research on the requirements of the norm-making technique established in accordance with the annex to the Law of the Republic of Belarus of July 17, 2018 No. 130-Z «On Normative Legal Acts» is intended to contribute to improving the quality of draft normative legal acts and the formation of uniform law enforcement practice.

For the convenience of employees of legal service involved in the preparation of draft acts, each point of the requirements of the norm-making technique is detailed and illustrated with new examples, taking into account the practice of its application that has already formed after the adoption of this Law. In order to ensure wide access for interested parties, the commentary is posted on electronic legal information resources (databank «Law Enforcement Practice” of the information retrieval system «Etalon», as well as «Reference Legal Systems of the ConsultantPlus Family»).

The National Center of Legislation and Legal Information has approved the following methodical recommendations:

• Methodical recommendations for preparing conclusions of compulsory legal expertise of draft laws;
• Methodical recommendations for conducting analytical researches of state, development trends and practice of legislation application;
• Methodical recommendations for preparing justifications for the need to adopt (issue) normative legal acts;
• Methodical recommendations on the application of the package principle for preparing draft normative legal acts;
• Methodical recommendations for preparing of annual plans of preparation of draft legislative acts, carrying out control over their implementation, as well as the implementation of the final provisions of laws.
