State programs and plans

Preparation of draft normative legal acts is carried out, as a rule, on a planned basis. Planning for the preparation of draft normative legal acts includes the development by norm-making bodies (officials):

state programs containing provisions on the preparation of draft normative legal acts (further – state programs);
plans for the preparation of draft legislative acts and other plans for the preparation of draft normative legal acts.

The National Center of Legislation and Legal Information develops the plans for the preparation of draft legislative acts and submits them in the established order for approval by the President of the Republic of Belarus. Plans for the preparation of draft legislative acts may provide for the development of concepts for the most significant and complex draft laws submitted for approval by the President of the Republic of Belarus.

Norm-making bodies (officials), on the basis of state programs and plans for the preparation of draft legislative acts, can develop and approve their plans.

When developing plans for the preparation of draft legislative acts, proposals from subjects of legislative initiative, state bodies and other organizations, including scientific, public associations, citizens are considered, and the results of scientific research in the field of law and legal monitoring are also taken into account.

State programs and plans for the preparation of draft normative legal acts are approved and published in the order provided for normative legal acts of the norm-making body (official) that approved them.

Proposals for the preparation of draft legislative acts and concepts of draft laws for the next calendar year are sent to the National Center of Legislation and Legal Information, as a rule, no later than September 1. Proposals for the preparation of draft legislative acts and concepts of draft laws received later than December 1 will not be accepted for consideration, unless otherwise determined by the President of the Republic of Belarus.

Control over the implementation of state programs and plans for the preparation of draft legislative acts is carried out by norm-making bodies (officials) that approved them, or by state bodies (organizations) authorized by them.

Control over the implementation of plans for the preparation of draft legislative acts is carried out by the National Center of Legislation and Legal Information.

According to the Edict of the President of the Republic of Belarus of November 17, 2020 No. 415 «On Increasing the Efficiency and Quality of Norm-making Activity» (subclauses 1.1–1.3, paragraph two of subclause 1.4 of clause 1), aimed at improving the planning of norm-making activities. According to the innovations, when carrying out norm-making activities and its planning, adjustments to normative legal acts are allowed no more than once every two years (except for the cases when such an adjustment is necessary for the immediate regulation of the most important issues or is carried out on the basis of the requirements of a normative legal act of greater legal force).

Edict of the President of the Republic of Belarus of November 17, 2020 No. 415 also provides for the preparation on a planned basis of draft normative legal acts of the President of the Republic of Belarus, which for the first time establish the regulation of public relations, systematically change the existing legal regulation, provide for new responsibilities or entail additional financial expenses for citizens and economic entities .

Since 2022, planning of norm-making activities of the President of the Republic of Belarus and the Parliament of the Republic of Belarus is carried out on the basis of plans for the preparation of draft legislative acts.

The inclusion of proposals for the preparation of draft legislative acts in the annual plan, as a rule, is carried out based on the results of legal monitoring.
